Welcome to the "AI Tom Bud" software and hardware products and related services!
The "AI Tom Bud" software and hardware products and related services (the "Services") refer to products and services operated by Hangzhou Qianyi Lingjing Intelligent Technology Co., Ltd. and/or its affiliates (collectively, "we," "us," or "our"), provided through [websites, applications, mini-programs, smart hardware, Software Development Kits (SDKs) for third-party platforms, Application Programming Interfaces (APIs), and future innovative formats enabled by technological advancements, including but not limited to platforms centered on "AI interactive dialogue" and other functionalities] (hereinafter referred to as the "Services"). This User Service Agreement ("Agreement") governs your registration, login, and use of the Services. This Agreement includes the main body and all rules we have published or may publish in the future regarding the Services.
By using our Services, you must read and understand all terms of this Agreement, especially those in bold, including disclaimers and liability limitations. If you disagree with this Agreement or any future modifications, you must immediately cease using our Services, which may result in incomplete service availability. By continuing to use the Services, you acknowledge full understanding and acceptance of this Agreement and all related policies (including the Privacy Policy and Privacy Protection Guidelines). We reserve the right to modify this Agreement and rules at any time. Unless otherwise required by law, updated terms take effect immediately upon publication. Continued use after modifications constitutes acceptance of the revised terms.
Please note:
This Agreement applies to you only if you are an AI Tom Bud user, meaning that you registered on our Platform with an e-mail address.
This Privacy Policy will not apply to you if you are an AITongBan(AI童伴) user, which means you registered on the Platform with a mobile number.
If you an AITongBan(AI童伴) user, your access to and/or use of our Platform shall be subject to the AITongBan(AI童伴) User Service Agreement instead of this Agreement.
To use the Services, you must be of full legal capacity. If you are under 18 or lack full legal capacity, you must review this Agreement with a legal guardian and obtain their consent before using the Services.
We may provide hardware, applications, mini-programs, and other formats to deliver the Services. Specific functionalities are subject to our real-time updates.
To enhance security and service quality, we may update, modify, suspend, or terminate part or all of the Services. We will notify you of material changes via appropriate means (e.g., system prompts, in-app messages).
The Services are for personal, non-commercial, family entertainment use only. Unauthorized actions, including adaptation, replication, mirroring, or commercial exploitation, are strictly prohibited without our prior written consent.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services. All rights not expressly granted herein are reserved by us.
To use the Services, you must register an account using a mobile number or email. You agree to provide accurate and lawful information. Failure to do so may restrict access.
Your account must comply with applicable laws. We reserve the right to review and reject non-compliant content.
You are responsible for maintaining account confidentiality and all activities conducted under your account. Notify us immediately of unauthorized use.
If your account is lost, contact customer support. We may require additional information to assist, but disclaim liability for losses beyond our control.
You have the right to use the Service in accordance with this Agreement. We reserve the right to expand, modify, or discontinue any feature or service component at our discretion, based on technical developments or business needs.
Protecting the security of your personal information is a core principle. We will process and safeguard any personal data you provide in compliance with this Agreement, our Privacy Policy, and Privacy Protection Guidelines, using reasonable technical and organizational measures to prevent unauthorized access, use, or disclosure. To learn more about how we collect, use, and share your personal data—and your rights as a data subject—please refer to our Privacy Policy and Privacy Protection Guidelines.
Unless we expressly agree otherwise in writing, you may only use the Service and any content it generates for personal, non-commercial, household entertainment purposes. You shall not copy, distribute, sell, sublicense, transfer, rent, lease, or otherwise exploit any part of the Service or its outputs for commercial gain.
In addition to this Agreement, you must comply with all applicable laws, regulations, and the rules and policies published on or linked from the Service (including the Privacy Policy and Privacy Protection Guidelines).
When using or interacting with the Service, you must act in good faith and may not engage in activities that violate laws or public order, including but not limited to:
Opposing constitutional principles;
Endangering national security or leaking state secrets;
Undermining national honor or interests;
Inciting ethnic hatred or discrimination;
Vilifying or desecrating national heroes or martyrs;
Promoting terrorism, extremism, or related activities;
Undermining religious policy, or promoting cults and superstition;
Spreading rumors or false information;
Disseminating obscene, pornographic, gambling-related, violent, or terroristic material;
Insulting, defaming, or infringing upon others’ rights (e.g., privacy, portrait, reputation);
Containing false, harmful, coercive, harassing, or otherwise objectionable content;
Disclosing others’ private or personal data without consent;
Any other content prohibited by law or regulation.
You may not use the Service to generate or disseminate content that:
Sensationalizes gossip, scandals, or adverse events;
Inappropriately comments on natural disasters or major accidents;
Contains sexual innuendo or explicit content;
Depicts graphic violence or gore;
Incites discrimination (e.g., based on region, ethnicity);
Promotes vulgar or tasteless material;
Encourages minors to imitate unsafe or immoral behaviors, or otherwise harms children’s welfare;
Advocates illegal assemblies, associations, or demonstrations;
Operates under the guise of an unlawful organization;
Otherwise damages the online ecosystem.
You shall not attempt to undermine or reverse engineer our Service, including but not limited to:
Inserting personal data into prompts without data-subject consent;
Generating infringing third-party content;
Removing or altering AI-generated watermarks or metadata;
Decompiling, disassembling, or otherwise attempting to discover the Service’s underlying code, algorithms, or models;
Scraping or programmatically extracting data at abnormal rates;
Using generated content to develop competing products or services;
Mirroring the Service interface or replicating functionality;
Removing or obscuring our trademarks, logos, or ownership notices;
Any other acts that could harm our lawful interests.
For any content you upload (text, images, audio, etc.), you represent and warrant that:
It does not violate the prohibitions in Sections 3.4, 3.5, or 3.6;
You own all rights or have obtained valid licenses and consents—including for personal data—to upload and use it;
It is truthful, accurate, objective, and appropriate for the Service’s intended purposes;
If it contains personal information, you have obtained explicit consent from the data subject or have lawfully anonymized the data.
Unless otherwise specified, the Service follows a “fair use” principle. You must not—through excessive frequency, forged requests, mass-account creation, or other technical means—obtain or use the Service beyond normal usage patterns. We reserve the right to throttle, limit, or suspend your access for abusive behavior.
If you violate this Article 3 or any other term, we may, at our sole discretion and without prior notice:
Issue warnings;
Restrict or suspend features;
Temporarily or permanently disable accounts;
Remove content;
Record relevant logs;
Report violations to law-enforcement or regulatory authorities.
You are solely responsible for any resulting liabilities, damages, or third-party claims, and shall indemnify us against any losses we incur due to your breach.
You should use AI Tom Bud thoughtfully, recognizing its limitations and avoiding excessive dependence or addictive usage patterns.
Unless expressly stated on a given interface or agreed in writing, the Service is not intended to serve as an automated decision-making tool; all outputs are provided for reference only.
We will use commercially reasonable efforts to maintain stability and integrity of the Service, and to provide safe, continuous operations in good faith, without arbitrary interruptions.
We reserve the right to review and approve or reject account registrations and to take appropriate action—including warning, limiting, suspending, terminating accounts, deleting content, or reporting to authorities—against any activity that violates applicable laws or this Agreement.
In accordance with applicable law, we may anonymize or pseudonymize interaction data to protect personal identity, using it solely to improve Service quality and user experience.
We will proactively fulfill all legal obligations, including but not limited to:
Ensuring generated content aligns with core socialist values (in China) and avoids illegal, harmful, or offensive content;
Protecting minors’ rights and avoiding content that harms their physical or mental health;
Preventing algorithmic bias and unfair competition;
Respecting third-party IP and trade secrets.
Personal data collected in mainland China will be stored there. We will not transfer such data abroad without your explicit consent or as required by law.
We will comply with lawful government or judicial requests, remove or restrict access to violating content, and correct our systems as required.
All IP rights in the Service and its outputs belong to the Company and are legally protected. Users may only use the Service and its IP per this Agreement.
By uploading content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, adapt, and distribute your content.
All data generated by the Service belong to us; you may not use such data beyond this Agreement.
Without our permission, do not use or register our trademarks or logos.
You bear all risks for using the Service. The Service is provided "as is" without warranties.
We are not liable for interruptions due to uncontrollable events such as natural disasters or network failures.
We do not guarantee the legality or accuracy of third-party content accessed via the Service.
Our data come from legal public sources and filtering but may contain flaws.
If you find issues, contact us at common@jktom.com or via in-app support with evidence.
We may modify, suspend, or terminate services for operational or security reasons at our discretion.
Guardians must supervise minors under 18 using the Service.
Guardians bear legal responsibility for minors' misuse.
Obtain consent before sharing minors' voice or image materials.
We may warn, remove content, suspend or close accounts for breaches without liability.
You indemnify us against claims arising from your breaches.
Ensure your content does not infringe third-party rights; we may remove infringing content.
This Agreement is governed by the laws of the People’s Republic of China. Disputes shall be litigated in the courts of Shangyu District, Shaoxing City, Zhejiang Province, PRC.
If any clause is invalid under PRC law, it shall be interpreted to reflect the original intent; the rest remain effective.
We may assign operations to affiliates or third parties; your continued use constitutes acceptance.
